Definitions On this Website: “Artist” means the student who uploads his artwork onto the Website for sale; “Artwork” means, for example, the painting, sculpture, photograph etc. that the Artist wants to sell using the Website; “Buyer” means the person buying Artwork using the Website; “BuyStudentArt” or “us” or “we” means the owner of the Website, BuyStudentArt Ltd; “Commission” means the fee we charge for advertising and selling Artwork on the Website; “Consumer” means an individual or a partnership consisting of two or three persons not all of whom are bodies corporate and an unincorporated body of persons which does not consist entirely of bodies corporate and is not a partnership; “Courier” means any person or business contracted by us to deliver the Artwork to the Buyer, whether all or part of the distance; “Website” means the www.BuyStudentArt.co.uk website; “you” or “your” means the user or viewer (and includes the Artist and Buyer) of the Website. For the Buyer The contract includes (amongst other things) information such as: price and payment; how the Artwork will be delivered to you; our returns policy, etc.. upload Artwork and use our on-line ordering service. The use of this Website is subject to the following conditions: There are some situations where we cannot accept Artwork or an order and, when you either upload Artwork or place an order in the order form, you will be asked to identify if any of these are applicable to you by either clicking on a “YES”. You will ensure that your responses are not misleading or inaccurate and, accordingly, you acknowledge that we are reliant on you to complete the relevant form accurately. For the Artist: The contract includes (amongst other things) information such as: how to upload details of your Artwork; your responsibilities; how to package the Artwork and deliver it to the Buyer; reasons why your Artwork could be withdrawn from our Website, etc.. Exclusivity of advertising and sale All uploaded Artwork shall be exclusively advertised and for sale on the Website. The Artwork must not be advertised or offered for sale anywhere else. The Artwork must not be worth more than £2,500 (two thousand, five hundred pounds sterling). Any unsold Artwork that you have removed from the Website may not be offered for sale by you elsewhere until after one (1) calendar month of its removal from the Website. In the event that (a) negotiations for the sale of the said removed Artwork have commenced; or (b) you sell such removed Artwork within one (1) calendar month of its removal from the Website you agree to pay the Commission to us. Removal of Artwork from the Website If you want to remove your Artwork from the Website (for example if it becomes damaged) then you must email info@BuyStudentArt.co.uk to have it removed. Sale and Delivery of Artwork Once the Artwork has been sold then you are responsible for packaging the Artwork. The Artwork MUST be appropriately packaged, for example: such Artwork as a photograph could be packaged in a strong cardboard-backed envelope whereas such as a fragile glass sculpture must, as a minimum, be bubble-wrapped and boxed. Further details will be given to you once the sale has been made. All expenses for and relating to the packaging are your responsibility. The Artwork MUST be sent by you to the Buyer by either Royal Mail (or Courier, depending on the type of Artwork). We will agree the appropriate method of delivery with you prior to you sending the Artwork. You MUST send the Artwork within two (2) working days of us notifying you that the Artwork has been sold and giving you the Buyer’s details. If you are unable to meet these timescales you MUST email info@buytstudentart.co.uk immediately so we can let the Buyer know there will be a delay in the Artwork being sent and how long the delay will be. In any event you must tell us a minimum of two (2) working days of your intention to take any holidays. We will pay you for any Artwork that is sold by us within thirty (30) days of the date the Artwork is delivered by the courier to the Buyer. We will pay you by PayPal, cheque or bank transfer in accordance with any arrangements we may make with you. This will include the 25% commission which will be debited before the 75% is paid to you. Reputation of www.BuyStudentArt.co.uk We consider our reputation to be very important. If you do not send the Artwork within the required two (2) days as stated above (unless you have notified us and we have notified the Buyer of a delay) or you sell the Artwork outside of this Website, this will have a detrimental effect on the Website’s reputation and will be dealt with by us accordingly. If the Artwork is returned due to any fault whatsoever caused by you (including but not limited to such reasons as falsifying the description, faulty Artwork or any other reason that we consider to be appropriate in the circumstances) then we will charge you the cost of the returns collection. Termination We may terminate our contract with you if you breach any of the conditions on this Website that are applicable to you. If we do decide to terminate our contract with you, we will give you written notice by e-mail of, and our reasons for, the termination. Formation of contract Set out below is a summary of the steps which you must follow in order to conclude a legally binding contract with us: Step 1: Provided that you agree unconditionally to these terms and conditions, you will be given the opportunity at the end of this document to click on the “YES” button. The next page after that to appear on your screen will be our standard order form which contains information on prices together with a description of the Artwork that is available and an explanation of methods of payment. Making A Purchase Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order. We accept card payments. We accept Visa and MasterCard. We do not charge for any item until it is ready to ship. Backordered items are not charged until they are shipped. If you do not wish to pay online, you may send your card information via phone, fax or by post. If you have made a mistake in your order and cannot correct it in the shopping cart, contact us and we will correct the mistake. When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. Shipping And Handling Delivery will be made by Royal Mail (potentially courier depending on the artwork) and sent by the student in the appropriate packaging. The deliveries will be sent to the the address you state on the order form so you will need to sign for the delivery. We cannot guarantee specific delivery dates. Delivery will only be made to the mainland UK.

Delivery Schedule We deliver your order right away. We will normally send your order to you in 3 business days. For International Orders you must email info@BuyStudentArt.co.uk to discuss. The artwork will be sent to you directly by the student. You must inform us within two working days if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem. Please quote your order number in all correspondence. You agree that proof of delivery supplied by our delivery company is sufficient evidence to establish that goods have been received.

Back Orders If your item is no longer available you will always be emailed with the option to cancel your order if you would rather not select an alternative.

Tax Charges For orders made from the UK or the European Union, 20.0% VAT is added.

Credit Card Security When the order is placed at our website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.

Returns Policy Your rights to return goods are protected under the EU Distance Selling Directive. You are entitled to cancel your order and return the goods within 7 working days for a full no quibble refund, including the cost of delivery.
